Terms of Service

Welcome to The Mallyard . By accessing or using The Mallyard, you agree to be bound by these Terms of Service. If you do not agree, you must not use the Platform.

1. Platform Role & Scope

The Mallyard is a premium digital marketplace facilitator designed to enable discovery, comparison, and connection between buyers, sellers, service providers, and delivery partners.

The Mallyard does not sell products or provide services directly, does not process or hold payments, and does not guarantee the quality, legality, or fulfillment of any listing.

All transactions, payments, and service fulfillment occur directly between users. The Platform exists to empower connection — not to participate in the transaction itself.

2. User Eligibility

You must be at least 18 years old to use the Platform. By using The Mallyard, you confirm that you have the legal capacity to enter into binding agreements.

3. Accounts & Verification

Access to certain features may require account creation. Sellers and service providers may undergo manual verification processes designed to enhance trust and platform quality.

Verification improves credibility but does not constitute endorsement, certification, or guarantee by The Mallyard.

The Mallyard reserves the right to suspend, restrict, or terminate accounts at its discretion.

4. User Conduct & Prohibited Listings

You agree not to use the Platform to list, promote, or facilitate:

• Counterfeit, stolen, or unlawfully obtained goods
• Weapons, hazardous materials, illegal substances, or controlled items
• Fraudulent, deceptive, or misleading services
• Any content or activity that violates applicable laws
• Regulated professional services (e.g. medical, legal, financial) without proper licensing

The Mallyard reserves the right to remove listings, restrict access, or terminate accounts where violations are suspected or identified.

5. Payments

Payments are conducted directly between users. The Mallyard is not a payment processor and does not facilitate or guarantee transactions.

Any disputes regarding payments must be resolved between the parties involved.

6. Delivery & Logistics

Delivery partners are independent third parties. The Mallyard does not employ or control them.

The Platform is not responsible for delays, loss, damage, or non-performance related to delivery.

7. Intellectual Property

All platform content, branding, and technology belong to The Mallyard or its licensors.

Users retain ownership of their content but grant The Mallyard a non-exclusive license to display, promote, and distribute it within the Platform.

8. Disputes Between Users

The Mallyard is not a party to any transaction or agreement between users.

In the event of disputes:

1. Users must first attempt resolution directly
2. Disputes may be reported for platform awareness
3. The Mallyard may apply trust or safety measures at its discretion
4. The Mallyard is not obligated to mediate or resolve disputes
5. Users retain the right to pursue legal remedies independently

This clause reinforces the Platform’s role as a facilitator — not an intermediary.

9. Limitation of Liability

To the maximum extent permitted by law, The Mallyard shall not be liable for:

• Indirect or consequential damages
• Losses arising from user transactions
• Actions or omissions of third parties

10. Termination

The Mallyard may suspend or terminate access to the Platform at any time for violations of these Terms or for platform integrity purposes.

11. Governing Law

These Terms are governed by the laws of the Republic of Zimbabwe, unless otherwise required by applicable law.
